INTRODUCTION

Gender equality and gender neutrality, are not mere terms but needs of the society. A gender-equal society should not have the term gender as everyone can be themselves without facing any discrimination. Gender neutrality refers to not relating or being specific to one gender whereas gender equality refers to giving the rights, opportunities, and responsibilities to all genders.

There was a need to bring up women in society with regards to education health and protect their rights, this led to the formation of various women-centric laws in India. These laws helped to safeguard the rights of women. The women raised their voices against the discrimination they faced and got their rights protected, but in today’s world, there is a misuse of such women-centric laws. The men in society are aggrieved by various law which favours women and hence there is a rise in talk regarding gender neutrality.

There are platforms established by the law, that women can approach in case of any discrimination or problems faced by them. There are no such platforms established by the law regarding protecting men. The question arises Why do we need such platforms specifically for men?


Why do we need to protect men?

 The National Crime Records Bureau published data for suicides committed in India, the suicides committed by men are comparatively higher than by women. This itself shows that there are many issues faced by men as well but there is no such platform specifically formed which would represent men’s issues and give a solution-oriented approach to their problems. Every person needs to have basic human rights and equal representation in the decision-making process in a democracy.


Discrimination faced by men

Indian constitution itself talks about gender equality but there exists a national commission for women but no such commission for men. The data collected by the National Commission for Women are used as inputs while framing laws, The problems faced by women are considered whereas there is no such platform to talk about men.

India is a country that has various ministries from Animals to forests but no such dedicated ministry or a government body that looks into the matter of men in the Indian society and issues faced by them.


Issues that need to be addressed


Ø  FALSE ACCUSATION

The judiciary is loaded with frivolous litigations against men if there was a National Commission for Men it would have entered earlier and looked into the matter and reduced the burden on the judiciary. There is a misuse of gender-biased laws. Generally, it is seen in matrimonial cases there are various frivolous charges imposed on them. Section 498A of the Indian Penal Code is one such section that is misused mostly in matrimony cases.

Ø  MEDIA TRIALS

The media portrays the men as villains in many frivolous cases to gain TRP and when the case turns out to be false they don’t correct the false news spread by them as that won’t bring TRP to the channels. Men many times are falsely convicted which leads to the loss of precious years of life that cannot be compensated. The reputation of the accused is destroyed and the person has to face various incidents of being publicly shamed.

Sarvjeet Singh vs State (Nct Of Delhi) & Anr. The case is one such case where the person had been subject to a media trial.

Ø  WORKPLACE ISSUE

If a case is filed against someone, they cannot get a good job as companies don’t prefer candidates with ongoing cases and reject them based on background verification. Innocent until proven guilty is just a sentence that is limited only to books in today’s world. Mental harassment in the workplace must also be considered.

Ø  RESEARCH AND DATA COLLECTION

The establishment of a commission will help to gather data and proper representation would help in resolving problems in society. The data collected by the National Commission for Women are used as inputs while framing laws The problems faced by women are considered whereas the is no such platform to talk about men. Establishing a specific body will help in the better representation of concerns and objections while framing laws.

Ø  DROPOUT FROM EDUCATION

There is a focus on the dropout rate of a female child and it is taken Into account that various remedies are provided whereas the dropout of a male is not considered much, establishing a National Commission for Men will lead to a specific focus on the issues related to men. The commission would create awareness and take various measures for reducing the dropout rate which will eventually lead to an educated society.

Ø  PATERNITY AND FATHERHOOD

Paternity and fatherhood are topics that are less talked about, in matrimony disputes it is necessary to consider custody of a child with a father. forming a National Commission for Men will help in promoting the rights of fathers and actively resolve concerns about parental responsibility. Generally, males are given the responsibility of earning and handling the financial responsibility and females are given the responsibility of taking care of the family and more emotional responsibility. Men in society have equal rights as women to take up caring roles.

UPDATION OF DATA

There are data collected for cases filed for offences committed against women by men in various cases whereas the data for people acquitted is not updated which portrays a wrong picture of the men in society.

SOCIAL AND LEGAL EQUALITY

Promoting legal and social equality is important it is an important aspect of establishing a National Commission for Men as it will promote social and legal equality and address issues faced by men with regards to matrimonial cases, domestic issues, custody battles, and also assistance to men who have been abused.

                                                              CONCLUSION

Forming a National Commission for men would lead to an equitable society as it would address issues faced by men and equal representation while making laws and surveys. The burden on the judiciary of frivolous cases against men and misuse of women-centric laws will be reduced. The commission would work on creating awareness about men’s rights along with responsibilities which would eventually lead to a better society. The awareness regarding mental health and physical health and problems faced will increase. The commission would further work on uncovering other issues faced by men and placing solutions to those issues. The establishment of a National Commission for Men would be a step towards a gender-equal society.
